These Terms of Service (“Terms”) govern the provision of services by Pawtato (“Pawtato”, “the Company”) to its Customers. By making a booking or using any Pawtato service, Customers agree to these Terms.
1. Definitions
• Customer: Any individual or entity who books or uses Pawtato’s services.
• Experience: A Pawtato studio session or any service provided by Pawtato.
• Deposit: A non-refundable sum required to reserve an Experience.
• Session: The booked period for a Pawtato Experience.
• Good Shots: Photographs selected based on positive visual characteristics, including focus, composition, and exposure.
2. Bookings and Deposits
2.1. Reservation Requirement
A deposit of SGD 30 is required to reserve an Experience. An Experience is not deemed booked or confirmed until the deposit has been received.
2.2. Payment Method
• Deposits must be paid via credit/debit card.
• All remaining payments, including fees for value-added services, shall be paid in full via PayNow after the Experience.
2.3. Refund Policy for Deposits
• All deposits are non-refundable.
• Deposits will only be refunded in full if Pawtato cancels the Experience.
3. Booking Policy and Rescheduling
3.1. Rescheduling by the Customer
• No rescheduling is permitted 12 hours or less before the Experience.
• If a Customer cancels or misses their booked session, their session and deposit will be forfeited.
• Rescheduling is permitted if done at least 12 hours before the Experience. Customers may reschedule without limitation, provided the request is received more than 12 hours in advance.
3.2. Rescheduling by Pawtato
Pawtato reserves the right to reschedule any Experience at any time. In such cases, Customers will be offered either:
• The opportunity to reschedule to an alternative date, or
• A full refund of the deposit.
No additional monetary compensation shall be provided.
3.3. Promotional Codes
Unless otherwise specified, promotional codes apply solely to Pawtato Experiences and cannot be used for product purchases, additional fees, or other charges.
4. Late Arrival
4.1. No Extension of Session Time
• Customers are expected to arrive on time for their Experience.
• Late arrivals will not be granted extra time, and no discounts or adjustments will be made for reduced session durations.
4.2. Liability for Delays
Pawtato is not responsible for delays caused by external factors (e.g., traffic or weather conditions).
5. Studio Accommodation
5.1. Session Capacity
• Pawtato’s 2.7-metre backdrop accommodates up to four individuals (including pets) at a time.
• The studio accommodates up to 10 guests, who may take turns during the session.
• Due to space constraints, Customers must adhere to the 10-guest limit.
6. Additional Fees
6.1. Maintenance Charges
A maintenance charge of SGD 15 will be imposed for any damage, soiling, or staining of backdrops due to incidents such as pet defecation or urination.
6.2. Damage and Reimbursement
For any damage to furniture or equipment caused by a Customer:
• Pawtato reserves the right to recover the full cost of the damaged item.
• An invoice will be issued within 14 days of the incident and must be settled within 30 days.
7. Indemnity and Liability
7.1. Customer Responsibility
• While Pawtato takes reasonable measures to ensure studio safety, it shall not be liable for injuries sustained during an Experience.
• To the maximum extent permitted by law, Customers indemnify Pawtato against any claims, damages, or losses arising from the use of its services.
7.2. Reimbursement for Medical Costs
If injuries caused by a Customer or their pet result in claims from Pawtato staff:
• Pawtato reserves the right to invoice the Customer for related medical expenses.
• The invoice will be issued within 14 days and must be paid within 30 days.
8. Safety and Conduct
8.1. Behaviour Towards Pawtato Staff
Verbal or physical abuse towards Pawtato staff is strictly prohibited. Pawtato reserves the right to terminate services immediately without compensation.
8.2. Right to Refuse Service
Pawtato may ban any Customer if their behaviour or that of their pet endangers other guests or staff.
8.3. Premature Termination Due to Pet Behaviour
If a pet poses a safety risk:
• Pawtato may terminate the Experience early.
• Full payment remains due.
• No monetary compensation will be provided, though a discretionary discount may be offered.
9. Photo and Editing Services
9.1. Delivery of Photographs
• Pawtato will provide edited photographs (“Good Shots”) selected based on focus, composition, and exposure.
• Photos will be delivered via a download link within three working days.
• Photo selection is at Pawtato’s sole discretion.
9.2. Editing Scope
Editing is limited to adjustments in colour, brightness, and sharpness. Digital alterations (e.g., changing physical features, removing blemishes) are not provided.
9.3. Customer Feedback on Photos
Customers may submit feedback within 14 days. One round of complimentary re-editing is available for technical corrections, in line with Pawtato’s editing style.
9.4. License for Photographs
Pawtato grants Customers a personal-use license for the photographs. Commercial rights remain exclusively with Pawtato.
10. Physical Goods
10.1. Scope
These terms apply only to separately purchased products. Complimentary products from an Experience are excluded.
10.2. Refund Policy
• No cash refunds will be issued once product packaging is opened, except in cases of product recall.
• A full refund is available for unopened, undamaged products.
10.3. Warranty and Replacement
• A 14-day warranty (from delivery) covers manufacturing defects.
• Incidental or accidental damage is not covered.
• Defective products must be returned to qualify for replacement.
11. CCTV in Studio
11.1. Recording Notice
Pawtato operates CCTV in the studio for the safety of Customers and staff. Recordings are retained for one year.
11.2. Retention and Use
• CCTV recordings may be retained longer for internal investigations or law enforcement purposes.
• Such recordings are exempt from Pawtato’s Privacy Policy.
12. General Provisions
12.1. Amendments
Pawtato may amend these Terms at any time without prior notice. Continued use of services constitutes acceptance of the revised Terms.
12.2. Governing Law and Jurisdiction
These Terms are governed by Singapore law. Any disputes shall be resolved in Singapore courts.
12.3. Severability
If any provision is found invalid, the remaining Terms remain in effect.
12.4. Entire Agreement
These Terms constitute the entire agreement between Pawtato and the Customer, superseding all prior agreements.
By booking an Experience or using Pawtato’s services, Customers acknowledge that they have read, understood, and agree to these Terms of Service.
